One of the most frustrating situations for CDL drivers is remaining in “Prohibited” status in the FMCSA Clearinghouse longer than expected.
Many drivers believe they completed everything correctly — only to discover they still cannot legally return to work.
Here are five common reasons drivers get stuck in prohibited status.
1. The SAP Process Was Never Started
The Return-to-Duty process begins with a qualified Substance Abuse Professional (SAP).
Without the SAP evaluation:
The process cannot move forward
RTD testing cannot begin
The driver remains prohibited
2. Treatment or Education Was Not Completed
The SAP may require:
Counseling
Education classes
Treatment programs
Follow-up evaluations
Failure to complete these requirements stops the RTD process immediately.
3. The Driver Never Took the RTD Test (Step 5)
A negative Return-to-Duty test is required before a driver can legally return to safety-sensitive work.
If the RTD test:
Was never scheduled
Was refused
Was positive
…the driver remains prohibited.
4. The Employer Failed to Report RTD Information
Even after passing the RTD test, employers or designated C/TPAs must report the information in the Clearinghouse.
